Comme les conflits accompagnent les relations humaines, tous les partenariats en cours incluent un système de justice. La question n'est pas de savoir si nous en avons un ou non, mais lequel nous choisissons. Pour les sociétés dominées par l'influence coloniale européenne, le système de justice par défaut est orienté par un ethos punitif qui cherche à séparer les personnes impliquées dans le conflit, et à imposer la douleur à la partie considérée comme ayant fait du tort. Le fait de retirer une pratique relationnelle et dialogique de son contexte d'origine et de l'introduire dans un système punitif fausse cette pratique et aligne ses résultats sur l'ethos directeur du système. Cela peut maintenant promouvoir une rétribution participative, mais ce n'est pas de la justice restaurative. Ainsi, la JR n'est jamais limitée ni définie par l'utilisation d'une certaine pratique, mais implique nécessairement le développement d'accords communautaires ou organisationnels - qui incluent et dépassent une pratique relationnelle - qui fournissent les conditions pour le dialogue et l'action restauratrice. »
